Kentucky Clarifies Legal Cannabis Options as Medical Marijuana Laws Evolve

LEXINGTON, KENTUCKY – The question surrounding the forms of legal cannabis available in the state continues to evolve as Kentucky embarks on its journey in medical cannabis legislation. Recently, the Kentucky Office of Medical Cannabis clarified the types of products that will be permitted under the law.

The law outlines specific formats for medical cannabis, which include edibles, oils, tinctures (cannabis extracts), vaping products, and raw plant material. However, certain restrictions apply, particularly for those under 21 years of age who are prohibited from purchasing or using vaping products.

Moreover, current state law maintains a prohibition against consuming raw plant material through smoking. Under Senate Bill 47, all packaging for raw plant materials must carry a label stating it is “not intended for consumption by smoking.” This regulation reflects ongoing concerns regarding the health implications associated with traditional smoking methods.

For registered medical cannabis patients, regulations specify the quantities they can possess. A patient is allowed a 30-day supply of medical cannabis at home and a 10-day supply that they may carry. The definitions of these supplies vary by the form of cannabis. A 30-day supply can include up to 112 grams of raw plant material, 28 grams of concentrate, or 3,900 milligrams of THC in edibles. In contrast, the 10-day supply is limited to 37.5 grams of raw plant material, 9.5 grams of concentrate, or 1,300 milligrams of THC in edible products.

The clarification regarding permissible forms and quantities of medical cannabis is crucial for potential users within Kentucky, as it sets clear boundaries for both consumption and purchase. As patient registration continues, the Kentucky Office of Medical Cannabis plays a pivotal role in guiding residents through the new legal landscape.

As the dialogue surrounding cannabis legislation progresses, it’s essential for the public to remain informed about the evolving regulations and available options.
